Commissions Information
Commissions will be available in limited slots when open. The number of slots may vary depending on the type and style of the commission.
To request a commission, please visit my Ko-fi page. The link is available on both of my Carrds.Updates regarding commission openings will be shared on my Bluesky account. Please note that commissions are offered on a first-come, first-served basis.

1. General Terms

Definitions:
The term “Client” refers to the person commissioning artwork. The term “Artist” refers to Fern Folk Studio.

By commissioning me, the Client confirms that they have read and agreed to all terms outlined in this document.

Privacy & Data Protection:
I will only use your personal information (like your name and email) to communicate about your commission. I will not share or sell your information to any individual or business.Limitation of Liability:
I am only responsible for issues directly related to your commission, and my liability is limited to the amount you paid. I am not responsible for any additional damages or issues related to the commission beyond that amount.By agreeing to these terms, you’re giving me permission to use your data only for this commission.
2. Pricing & Payment
(( Base Pricing ))
All pricing and payment are in USD only.The base prices are displayed clearly on each commission listing via my Ko-fi page. Customizations, add-ons, or requests for complex details may incur additional charges. These will be communicated to the Client and agreed upon before work begins.

(( Add-ons & Customization ))
Add-ons and complex details (e.g., tattoos, wings, scales, etc.) may not always be available, depending on the commission type. Availability will be specified in individual listings.Any additional charges for add-ons or requests for complex details will be determined and agreed upon before payment.

(( Payment Methods ))
Payments must be made in full before I begin work on personal commissions. All payments should be made through Ko-fi and processed via PayPal.For commercial commissions, I may ask for a deposit upfront, and the remainder will be due before the final artwork is delivered. All payments should be made via PayPal.-
(( Refunds and Cancellations ))
Before Work Begins:
All deposits for payment plans are non-refundable. Should any commission be cancelled before work has begun a partial refund may be provided at my discretion.After Work Begins:
Once I’ve started working on your commission, I can’t offer refunds. If you cancel after the work has begun, you will need to pay for the portion of the work that has already been completed.
3. Commission Process
(( Providing Reference Materials ))
The Client is responsible for sending me clear and detailed reference materials (such as images and descriptions). The more information provided, the better I can understand what you want. If you don’t send enough details, it may delay the process, and that delay will be your responsibility.

(( Modifications & Revisions ))
Before Work Begins:
The Client can request changes, add-ons, or upgrades to the commission before I start. However, if you ask for anything extra, there may be additional charges.After Work Begins:
Once I start, you can still ask for minor changes, but major changes will not be accepted. If you want something completely different, it may require a new commission.

(( Revisions Policy ))
The price of the commission includes up to 2 rounds of minor revisions (like for sketches or line art). Once you approve a stage (e.g., sketch or line art), no further revisions will be made to that stage unless additional fees are agreed upon.-
(( Commission Queue & Progress ))
Once payment is received, the commission will be added to my Commissions Queue, which can be tracked on my Ko-fi page.While I strive to update the queue promptly, there may be delays in reflecting the most current information.
4. Delivery
(( Turnaround Times ))
I will give you an estimate of how long the commission will take, but please note that things like emergencies, a high number of commissions, or delays in communication may cause some delays. If anything affects the timing, I’ll let you know as soon as possible.(( Final Delivery & File Formats ))
Once the artwork is done, I will send you the final high-resolution file in PNG or JPEG format, or the format otherwise agreed upon. If you need layered files (such as PSDs), you can ask, but there may be an extra charge incurred for them.Additional charges may apply, and I reserve the right to decline any such requests.(( Gift Commissions: ))
If your commission is a gift or surprise for someone else, you’re responsible for giving me the correct contact details for the recipient (such as an email address for delivery). I am not responsible if there are issues with delivery due to incorrect information.
5. Copyright and Usage
(( Partial Ownership of Commissioned Artworks ))
The Artist reserves the right to display the commissioned artwork in a portfolio, on social media, and for other promotional purposes, unless an exclusive rights agreement has been made.(( Personal Use ))
The Client can use the artwork for personal purposes, like printing it or sharing it on social media, as long as you give proper credit (e.g., “Art by Fern Folk Studio”). You can’t remove or hide any signatures or watermarks.

(( Commercial Use ))
If the Client wants to use the artwork for commercial purposes (like selling products or advertising), the Client needs to get explicit permission from the Artist, and a separate commercial license will need to be purchased. This will cost extra.

(( Exclusive Rights ))
Unless we agree otherwise, I keep full copyright of the artwork. I can use it in my portfolio or promotional materials. If you want exclusive rights, where you own all usage rights, that will need to be agreed upon in a separate contract.
6. Prohibited Behavior & Uses
The Artist can cancel the Client's commission and issue no refund if engaged in any of the following behaviors:> Hate speech or discrimination against any group (based on race, gender, sexuality, disability, etc.)> Harassment, threats, or abusive language> Repeated requests for discounts or free work after we’ve agreed on terms or prior to commissioning.> Attempting to bypass or ignore these terms(( Prohibited Uses ))
The Client is not allowed to use the artwork for any kind of commercial marketplace (like selling it or using it as an NFT).You also can’t alter, trace, or reproduce the artwork for commercial purposes unless you’ve purchased exclusive rights. You also can’t use the artwork in any AI (artificial intelligence) programs, such as training algorithms or creating new images.Any violation of these terms may result in blacklisting, termination of the agreement, and legal action.
7. Chargebacks and Disputes
Chargebacks:
If the Client files a chargeback without first communicating with the Artist, a permanent ban will be enacted for future commissions.

Disputes:
If there’s a problem with the Client's commission, I’ll do my best to resolve it through direct communication. If we can’t resolve it, we may consider mediation or third-party arbitration to settle the matter.(( Dispute Resolution ))
If we have a dispute regarding your commission, we’ll first try to work it out through direct communication. If we can’t reach an agreement, we may consider mediation or third-party arbitration to resolve the issue amicably.

Jurisdiction:
This agreement is governed by the laws of North Carolina, USA. Any legal disputes will be subject to the exclusive jurisdiction of courts located within Wake County, NC.
8. Additional Disclaimers
(( Cancellations ))
I reserve the right to cancel a commission at any time. If I need to cancel your commission, I will issue a full refund.(( Delays ))
I am not responsible for delays caused by things like personal emergencies, technical issues, or delays in communication on your end. If the delay is on my end, I will notify you as soon as possible and work with you to accommodate the situation.(( File Types and Delivery ))
If you can’t open the files I send, it’s your responsibility to ensure your software is compatible with the file type. If the file becomes lost or corrupted after delivery, I’ll try to resend it, but I can’t guarantee it will always be available.

By commissioning me, you confirm that you’ve read and agree to all the terms in this document.
